Terms of Use

These Terms of Use ("Terms") govern your access to and use of the websites located at ResetLending.com and MyResetLoan.com (collectively, the "Sites"), owned and operated by TriPoint Lending, LLC, doing business as Reset Lending ("Reset Lending," "we," "us," or "our"). By accessing or using the Sites, clicking "Submit," or checking any agreement checkbox, you agree to be legally bound by these Terms and our Privacy Policy, GLBA Privacy Notice, and Opt-Out Policy (all incorporated herein by reference).

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SITES.

We reserve the right to modify these Terms at any time. Changes are effective upon posting. Continued use of the Sites after changes constitutes acceptance. It is your responsibility to review these Terms periodically.

Reset Lending operates as a loan brokerage marketplace and financial services intermediary. Our Sites allow consumers to submit personal loan inquiries that may be matched with third-party lending partners, financial institutions, and other service providers (collectively, "Lenders"). Reset Lending is not a direct lender for all products and does not make lending decisions or guarantee the availability, approval, or terms of any loan.

Services provided through the Sites include:

• Online personal loan inquiry and pre-qualification process
• Rate and offer comparison tools
• Referral services to partner lenders
• Informational content regarding personal finance and lending

We reserve the right to modify, suspend, or discontinue any portion of the Sites or Services at any time without notice.

To use the Sites, you must:

• Be a resident of the United States (continental U.S., Alaska, or Hawaii)
• Be at least 18 years of age (19 in Alabama and Nebraska; 21 in Puerto Rico)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Sites under any applicable law

Use of the Sites by persons outside the United States or persons who do not meet the above criteria is prohibited.

By using the Sites and submitting information, you represent and warrant that:

• All information you provide is true, accurate, current, and complete
• You are submitting information for yourself, not on behalf of another person without authorization
• You are not using the Sites for fraudulent, illegal, or unauthorized purposes
• You will promptly update your information if it changes
• You have read, understand, and agree to be contacted pursuant to these Terms and the Privacy Policy

You understand that providing false or misleading information may result in termination of your access and could subject you to civil or criminal liability.

By using the Sites, you consent to receive communications from Reset Lending electronically, including via email, text message, and phone. These communications may include transaction confirmations, account information, marketing offers, and legal notices.

By providing your telephone number on the Sites, you expressly consent and request to receive telephone calls (including using an automatic telephone dialing system (ATDS) or prerecorded/artificial voice messages) and SMS/text messages from Reset Lending, its affiliates, and its lending partners, even if your number is on a state or federal Do Not Call list. This consent covers calls and messages relating to your loan inquiry and related financial products.

Current lending partners and affiliates include, but are not limited to: Best Egg, Happy Money, LendingClub, LendingPoint, LightStream, OneMain Financial, Prosper, SoFi, Upgrade, Upstart, and their respective affiliates.

Consent to receive calls or texts is NOT a condition of receiving any product or service. Standard message and data rates may apply. Message frequency varies.

To opt out of SMS messages, text STOP to any text from us. To opt out of telemarketing calls, see our Opt-Out page or contact us per Section 17.

By submitting a loan inquiry through the Sites, you authorize Reset Lending and its lending partners to obtain your consumer credit report and other information about you from credit bureaus and other consumer reporting agencies. A soft credit inquiry will be conducted during pre-qualification, which will not affect your credit score. A hard inquiry may be conducted by a Lender only upon your express consent and acceptance of a loan offer to confirm information provided in the application and creditworthiness.

You agree not to use the Sites or Services to:

• Violate any applicable federal, state, or local law or regulation, including the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, the Gramm-Leach-Bliley Act, or any applicable state consumer protection, lending, or privacy laws
• Submit false, inaccurate, misleading, or fraudulent information
• Impersonate any person or entity or misrepresent your identity or affiliation
• Transmit unsolicited commercial communications (spam)
• Introduce malware, viruses, or other harmful code
• Interfere with, disrupt, or circumvent the security of the Sites or servers
• Use automated scripts, bots, scrapers, or similar tools to access the Sites
• Harvest or collect personal information of other users
• Use the Sites for any purpose that would violate these Terms or applicable law
• Reproduce, resell, or commercialize any portion of the Sites without written consent

All content on the Sites, including text, graphics, logos, images, software, and other materials, is the property of TriPoint Lending, LLC dba Reset Lending or its licensors and is protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Sites for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from the Sites without our prior written consent.

The Sites may contain links to third-party websites, including lending partners. We do not control and are not responsible for the content, privacy practices, or terms of third-party sites. The inclusion of any link does not imply or constitute an affiliation, sponsorship, endorsement, approval, investigation, verification, or monitoring by Us of any information contained on those third party websites. You access third-party sites at your own risk and subject to their terms and conditions.

When you are redirected to a Lender's platform to complete a loan application, the Lender's own privacy policy and terms apply. We encourage you to review those policies carefully.

YOUR CORRESPONDENCE AND BUSINESS DEALINGS WITH OTHERS FOUND ON OR THROUGH THE THIRD-PARTY WEBSITES AND/OR SERVICES, INCLUDING, WITHOUT LIMITATION, THE PAYMENT AND DELIVERY OF PRODUCTS AND SERVICES, AND ANY TERMS, CONDITIONS, WARRANTIES AND REPRESENTATIONS ASSOCIATED WITH ANY SUCH DEALINGS, ARE SOLELY BETWEEN YOU AND THE THIRD-PARTY. YOU HEREBY IRREVOCABLY WAIVE ALL RIGHTS RELATED TO, AND RELEASE THE RELEASED PARTIES FROM AND AGAINST, ANY LIABILITIES ARISING FROM OR RELATED TO THE CONTENTS OF ANY THIRD-PARTY WEBSITE.

THE SITES AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SITES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE SITES OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE INFORMATION ON THE SITES IS ACCURATE, COMPLETE, OR CURRENT.

RATE QUOTES AND PRE-QUALIFICATION RESULTS ARE ESTIMATES ONLY AND DO NOT CONSTITUTE AN OFFER OR GUARANTEE OF CREDIT. ACTUAL LOAN TERMS ARE SUBJECT TO LENDER UNDERWRITING AND APPROVAL.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIPOINT LENDING, LLC DBA RESET LENDING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITES OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITES OR SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.

You agree to indemnify, defend, and hold harmless TriPoint Lending, LLC dba Reset Lending, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) your use of the Sites or Services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any information you submit through the Sites.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Federal law shall also apply where applicable.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for claims that qualify for small claims court, you and Reset Lending agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Sites by binding individual arbitration under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court. This means you waive your right to a jury trial and to participate in a class action.

Arbitration shall be conducted in Irvine, California, or by telephone/video as agreed. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

YOU AND RESET LENDING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to address emergency situations.

Your use of the Sites is also governed by our Privacy Policy and GLBA Financial Privacy Notice, both of which are incorporated into these Terms by reference. Please review those documents carefully.

We reserve the right to terminate or suspend your access to the Sites at any time, with or without cause, and without notice or liability. Sections 8, 10, 11, 12, 13, and 15 through 17 shall survive termination.

• Entire Agreement: These Terms, together with our Privacy Policy and GLBA Notice, constitute the entire agreement between you and Reset Lending regarding the Sites.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• Waiver: Failure to enforce any right is not a waiver of that right.
• Assignment: We may assign our rights and obligations under these Terms without notice. You may not assign your rights.
• Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.
• No Joint Venture: Nothing in these Terms creates a partnership, agency, or employment relationship.
